If you have lost a family member in an accident caused by the negligent act of another person, your claim is referred to as a "wrongful death" claim. The Arizona wrongful death statute controls who can make a wrongful death claim after an individual has been killed in an accident. If you are entitled to make a claim under the wrongful death statute, you must still prove fault against the person who caused the accident as well as the economic and emotional value of the loss you have experienced because of the individual's death. The last thing that a person making a wrongful death claim needs is the additional stress and frustration of dealing with an insurance company that may try to undervalue your relationship with the deceased person in order to withhold payment on the claim. Sometimes disputes arise among several statutory wrongful death claimants as to who should get a large or smaller percentage of a limited insurance policy.
